By accessing or using ZayPOS (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using ZayPOS on behalf of a business, you represent that you have authority to bind that business to these Terms.
These Terms constitute a legally binding agreement between you and Zayn Productions Ltd (Company No. 16892199), registered at 1 Alvin Street, Gloucester, England, GL1 3EJ ("we", "us", "ZayPOS").
ZayPOS provides a cloud-based point-of-sale platform designed for food and drink businesses, including order management, payment processing, staff management, inventory tracking, food safety compliance tools, and related features.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where possible. We will endeavour to give at least 30 days' notice of any material changes to core functionality.
We aim for 99.9% uptime but do not guarantee uninterrupted availability. Planned maintenance will be communicated in advance where possible.
You are responsible for maintaining the security of your account credentials. You must not share login details or allow unauthorised access to your account. You are responsible for all activity that occurs under your account.
You must be at least 18 years old to create an account. By registering, you confirm that all information you provide is accurate and complete.
ZayPOS offers a 14-day free trial with full access to features included in your chosen plan. No payment details are required during the trial. At the end of the trial, you may choose to subscribe or your account will be downgraded.
Paid subscriptions are billed per user per month (or per year for annual plans). Prices are as displayed on our pricing page and are inclusive of VAT where applicable.
Payments are processed securely via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis. If payment fails, we will notify you and may suspend access until payment is resolved.
We offer a 14-day money-back guarantee on first-time paid subscriptions. After this period, subscription fees are non-refundable except where required by law. Annual plan refunds are assessed on a case-by-case basis.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.

You retain ownership of all data you input into ZayPOS ("Customer Data"). By using the Service, you grant us a limited licence to process that data solely for the purpose of providing the Service to you.
We will not use your Customer Data for our own commercial purposes, share it with third parties for marketing, or claim ownership over it. Upon account termination, you may request an export of your data within 30 days.

The ZayPOS platform, including its software, design, branding, and content, is the intellectual property of Zayn Productions Ltd. Nothing in these Terms grants you ownership of or rights to ZayPOS IP beyond the limited right to use the Service as described.
You retain all rights to your own business data, branding, and content uploaded to the platform.
To the fullest extent permitted by law, Zayn Productions Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability to you shall not exceed the amounts you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
You may stop using ZayPOS and cancel your subscription at any time. We may suspend or terminate your account if you materially breach these Terms, fail to pay subscription fees, or if we have reason to believe your use poses a legal or security risk.
On termination, your right to access the Service ceases. We will retain your data for 30 days after termination, during which you may request an export. After this period, your data will be deleted from our systems.
These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of ZayPOS shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or in-app notification. Continued use of ZayPOS after the effective date constitutes acceptance of the updated Terms.
